Acceptable Use Policy
This Acceptable Use Policy (“Policy”) governs the use of GiveBrick’s websites, applications, digital campaign walls, payment features, and related services collectively referred to as the “Service.”
The Service is operated by Tessable LLC, doing business as GiveBrick (“GiveBrick,” “we,” “us,” or “our”).
This Policy applies to campaign organizers, supporters who purchase digital bricks, account holders, visitors, and anyone who submits content to or interacts with the Service.
This Policy is incorporated into the GiveBrick Terms of Service. Capitalized terms not defined here have the meanings given in the Terms of Service.
1. Purpose of This Policy
GiveBrick enables approved schools, churches, teams, booster organizations, memorial organizers, nonprofits, and community organizations to raise money by selling personalized digital bricks on a public campaign wall.
Supporters purchase a digital recognition item, add a name and optional message, and help reveal the campaign image as bricks are claimed.
GiveBrick is intended for lawful, authorized, respectful, and transparent community fundraising and recognition. You may not use the Service in a manner that harms another person, misleads supporters, infringes legal rights, compromises payment integrity, or threatens the security or reputation of GiveBrick or its users.
2. Eligible Campaigns
GiveBrick may approve campaigns for purposes such as:
- School programs, facilities, activities, and parent-teacher organizations;
- Church facilities, ministries, missions, and community programs;
- Athletic teams, school teams, booster organizations, and recognized sports organizations;
- Memorials created with appropriate family or estate authorization;
- Nonprofit programs and projects;
- Community improvements;
- Public-service initiatives;
- Capital projects;
- Equipment purchases;
- Scholarships and educational programs; and
- Other lawful community purposes approved by GiveBrick.
Team campaigns must be operated by an authorized school, athletic department, booster organization, nonprofit, league, club, or other recognized organization. An individual may not create a campaign in the name of a team or organization without authorization.
GiveBrick may decline a campaign even when the proposed use is not specifically prohibited. Campaign approval is discretionary and may consider legal, payment, reputational, safety, operational, or community concerns.
3. Organizer Authorization
A campaign organizer must have genuine authority to create and operate the campaign.
Organizers may not:
- Pretend to represent an organization, team, school, church, family, estate, nonprofit, or community group;
- Create a campaign without the organization’s knowledge or authorization;
- Use an organization’s name, logo, branding, property, photographs, or reputation without permission;
- Direct organization campaign proceeds to an unauthorized personal account;
- Provide a false name, title, role, affiliation, tax status, or organizational relationship;
- Submit false or misleading verification information;
- Circumvent GiveBrick’s application, review, signatory, payout, or approval requirements; or
- Continue operating a campaign after their authority has ended.
GiveBrick may require confirmation from an authorized person, including a principal, superintendent, school officer, pastor, church officer, nonprofit officer, board member, athletic director, booster officer, executor, family representative, or another appropriate signatory.
For schools, churches, and nonprofit organizations, GiveBrick may require the campaign’s Stripe payout account to be established in the name of an organization, business, nonprofit, or governmental entity rather than an individual.
4. Truthful Campaign Information
Campaign organizers must provide accurate, complete, and nonmisleading information.
A campaign may not:
- Misrepresent its purpose;
- Misstate the amount sought or expected project cost;
- Falsely describe how proceeds will be used;
- Falsely claim that a project has been approved, endorsed, or sponsored;
- Misrepresent the campaign’s relationship with GiveBrick;
- Imply that GiveBrick endorses or guarantees the organizer or project;
- Falsely claim charitable, nonprofit, governmental, educational, or tax-exempt status;
- Conceal a material beneficiary, financial interest, or conflict;
- Use fabricated supporters, purchases, testimonials, progress figures, or endorsements;
- Falsely suggest that a funding goal must be reached before proceeds are paid; or
- Continue displaying materially outdated or misleading information after becoming aware of it.
Organizers must use proceeds consistently with the material representations made on the campaign page.
5. Purchases, Not Charitable Donations
GiveBrick treats brick transactions as purchases of personalized digital recognition items.
Organizers and supporters may not use the Service to falsely represent that:
- GiveBrick is a charitable organization;
- GiveBrick is receiving or holding charitable donations;
- Every brick purchase is tax-deductible;
- GiveBrick provides tax advice or determines deductibility; or
- Purchasing a brick gives the supporter ownership in a physical structure, organization, project, or property.
An organizer may describe its own tax-exempt status or provide its own tax acknowledgment only when the statement is accurate and legally supportable.
Organizers are responsible for consulting qualified tax or legal professionals concerning tax deductibility, acknowledgments, charitable-solicitation requirements, and related disclosures.
6. Campaign Images, Names, Logos, and Likenesses
Organizers may upload or use only content they own or are legally authorized to use.
Campaign content may not include:
- Copyrighted photographs, illustrations, artwork, video frames, or designs used without permission;
- Trademarks, logos, uniforms, mascots, or branding used without authorization;
- A person’s name, photograph, voice, signature, likeness, or personal story without appropriate consent or another valid legal basis;
- Private photographs obtained or published without permission;
- Misleadingly edited or manipulated images;
- Content falsely implying sponsorship, endorsement, affiliation, or approval;
- Confidential documents or private records;
- Images taken from social media merely because they are publicly visible; or
- Material that violates another person’s copyright, trademark, privacy, publicity, contractual, or other rights.
Memorial campaigns
A memorial campaign must be authorized by an appropriate family member, estate representative, memorial committee, organization, or other person with authority.
Memorial organizers may not exploit a death, tragedy, illness, accident, crime, or disaster without appropriate consent.
Public figures
A campaign may not use a celebrity, athlete, politician, public official, influencer, or other public figure as its principal subject without appropriate authorization or a legally valid basis approved by GiveBrick.
Public availability of an image does not automatically grant permission to use it for fundraising or commercial recognition.
7. Brick Names, Messages, and Links
Brick content is public. Supporters must not submit information they do not want displayed publicly.
A brick name, message, dedication, or link may not contain or promote:
- Threats, intimidation, harassment, stalking, or bullying;
- Hate speech or content attacking or demeaning a person or group based on a protected characteristic;
- Calls for violence or praise of violent acts;
- Sexually explicit or pornographic content;
- Sexual content involving or directed toward minors;
- Exploitation, grooming, or endangerment of children;
- Defamatory accusations or knowingly false factual claims;
- Personal attacks unrelated to the campaign;
- Revenge content or content intended to humiliate another person;
- Social Security numbers, financial-account information, passwords, medical records, private addresses, or other sensitive personal information;
- Another person’s personal information shared without permission;
- Illegal goods, services, conduct, or instructions;
- Controlled substances or unlawful drug activity;
- Weapons sales or unlawful weapons activity;
- Fraudulent investment, financial, employment, or business opportunities;
- Spam, unrelated advertising, affiliate promotions, or repetitive solicitation;
- Malware, deceptive redirects, phishing pages, or unsafe links;
- Copyright, trademark, privacy, or publicity-right violations;
- Impersonation or false affiliation;
- Profanity or obscenity that GiveBrick or the organizer considers unsuitable for the campaign’s audience;
- Encoded, abbreviated, misspelled, symbolic, or disguised content intended to evade moderation; or
- Any content prohibited elsewhere in this Policy.
GiveBrick may impose character limits and technical restrictions on brick content.
Automated filters may identify some prohibited content, but GiveBrick does not guarantee that every message will be screened before appearing publicly.
8. Children and Youth Organizations
Campaigns involving schools, youth teams, churches, clubs, or other youth organizations must protect children’s privacy and safety.
You may not:
- Publish a child’s full identifying information without appropriate permission;
- Disclose a child’s private address, schedule, telephone number, email address, school records, medical information, or other sensitive information;
- Use a child’s image or likeness without authorization where authorization is required;
- Create content that sexualizes, exploits, humiliates, threatens, or endangers a child;
- Encourage private or inappropriate contact with a child;
- Link to content that is unsuitable for children in connection with a youth campaign; or
- Use youth-related campaigns to conceal fundraising for an unauthorized person or purpose.
Organizers are responsible for obtaining any parental, guardian, school, league, or organizational permissions required for campaign images and content.
9. Prohibited Campaigns and Purposes
GiveBrick may not be used for:
- Fraudulent, deceptive, or materially misleading fundraising;
- Campaigns operated without authorization;
- Political campaign contributions;
- Candidate fundraising;
- Political-action committee activity;
- Electioneering or fundraising regulated as political contributions;
- Campaigns supporting or opposing a candidate for public office;
- Money laundering;
- Tax evasion;
- Sanctions evasion;
- Terrorism financing;
- Extremist or terrorist organizations;
- Criminal activity;
- Illegal drugs or controlled substances;
- Illegal weapons or explosives;
- Human trafficking or exploitation;
- Hate groups or organized harassment;
- Pornography or sexual services;
- Gambling operations or unlawful gaming;
- Pyramid schemes, Ponzi schemes, or deceptive investment offerings;
- Bail, criminal defense, fines, penalties, or activity intended to obstruct law enforcement, unless GiveBrick expressly approves the campaign after legal review;
- Personal enrichment falsely presented as an organizational or charitable project;
- Unauthorized disaster, tragedy, medical, or memorial fundraising;
- The sale of regulated goods or services;
- Campaigns prohibited by Stripe or another payment provider; or
- Any purpose that violates applicable law or creates unreasonable legal, payment, reputational, or safety risk.
General civic, historical, educational, or public-service content is not automatically prohibited merely because it relates to government or public affairs. GiveBrick may nevertheless reject any campaign that could reasonably be treated as political fundraising or election activity.
10. Payment and Payout Integrity
Users may not manipulate or misuse GiveBrick’s payment system.
Prohibited conduct includes:
- Using stolen, unauthorized, fraudulent, or fictitious payment methods;
- Purchasing bricks to test stolen cards;
- Creating fake purchases to inflate campaign progress;
- Coordinating purchases intended to disguise the source or destination of funds;
- Laundering money through purchases, tips, refunds, or chargebacks;
- Splitting transactions to avoid review or reporting requirements;
- Directing organization proceeds to an unauthorized personal payout account;
- Providing false identity, banking, tax, ownership, or business information to Stripe or GiveBrick;
- Attempting to evade GiveBrick’s 15% fee;
- Directing supporters to pay outside GiveBrick to avoid agreed fees after using GiveBrick to solicit the purchase;
- Manipulating the optional processing-coverage amount;
- Misusing refunds, disputes, or chargebacks;
- Making a knowingly false chargeback claim;
- Attempting to purchase the same brick through concurrent or automated checkouts;
- Exploiting payment, reservation, refund, or payout errors; or
- Interfering with Stripe Connect onboarding or account monitoring.
GiveBrick may delay publication, restrict checkout, suspend a campaign, or take other appropriate action when payment or payout activity appears suspicious.
11. Technical and Security Restrictions
You may not:
- Access or attempt to access another person’s account;
- Bypass authentication, authorization, review, moderation, or security controls;
- Attempt to obtain administrative privileges;
- Probe, scan, or test the vulnerability of the Service without written authorization;
- Introduce malware, ransomware, malicious scripts, or harmful code;
- Interfere with the availability or performance of the Service;
- Overload the Service with automated requests;
- Use bots, scrapers, crawlers, or automation without written permission;
- Reverse engineer or attempt to extract nonpublic source code, data, credentials, or security mechanisms;
- Manipulate campaign, brick, purchase, ownership, progress, review, or payout records;
- Intercept payment or authentication communications;
- Attempt to forge Stripe webhook events or payment confirmations;
- Circumvent brick-reservation controls;
- Harvest supporter or organizer information;
- Use the Service to send spam, phishing messages, or unsolicited promotions;
- Create multiple accounts to evade a restriction or suspension;
- Share, sell, or transfer organizer access without authorization; or
- Encourage another person to engage in prohibited technical conduct.
Good-faith security concerns should be reported privately to security@givebrick.com and must not be publicly disclosed before GiveBrick has had a reasonable opportunity to investigate and address them.
12. Impersonation and Misrepresentation
You may not impersonate or falsely claim to represent:
- GiveBrick or Tessable LLC;
- A campaign organizer;
- A school, church, team, booster organization, nonprofit, or memorial;
- A government agency or public official;
- A campaign beneficiary;
- A supporter;
- A family member or estate representative; or
- Any other person or organization.
You may not create a campaign page, brick message, email, social-media post, or website that falsely suggests it is an official GiveBrick communication or an approved GiveBrick campaign.
13. Intellectual-Property Complaints
A rights holder who believes content on GiveBrick infringes a copyright, trademark, publicity right, or other intellectual-property right may send a complaint to:
The complaint should include:
- Identification of the protected work, mark, image, or right;
- Identification of the allegedly infringing campaign or brick;
- The campaign URL or other information sufficient to locate the material;
- The complainant’s name and contact information;
- A description of the complainant’s ownership or authority;
- A good-faith statement explaining why the use is unauthorized; and
- Any supporting documentation reasonably available.
GiveBrick may remove or disable content while reviewing a complaint.
Knowingly submitting a false or materially misleading infringement complaint may expose the complainant to legal liability.
14. Reporting Violations
To report content or conduct that may violate this Policy, email:
Include, where possible:
- The campaign URL;
- The brick number or location;
- A screenshot;
- A description of the issue;
- The reason you believe the content violates this Policy;
- Your contact information; and
- Any supporting documentation.
For urgent threats to life or safety, contact emergency services or the appropriate law-enforcement agency before contacting GiveBrick.
GiveBrick may acknowledge a report but cannot guarantee that it will provide the reporting person with confidential information, investigation details, or the outcome of an enforcement review.
15. Moderation and Organizer Responsibilities
Campaign organizers are responsible for monitoring their walls and responding reasonably to inappropriate content, correction requests, and reports.
An organizer may edit, clear, hide, or request removal of a brick’s public name, message, or link.
GiveBrick may review content before or after it appears publicly. GiveBrick may also change a brick’s moderation status so that its name, message, or link is no longer displayed while the purchased portion of the campaign image remains revealed.
GiveBrick is not required to pre-screen every campaign, image, brick message, or link and does not endorse content merely because it appears on the Service.
16. Enforcement
If GiveBrick reasonably believes that content, an account, a campaign, a payment, or other conduct violates this Policy, the Terms of Service, payment-provider requirements, or applicable law, GiveBrick may take one or more of the following actions:
- Request information, identification, authorization, or documentation;
- Request changes to a campaign;
- Reject a campaign application;
- Refuse publication;
- Hide, edit, disable, or remove content;
- Disable a link;
- Clear a brick’s public name or message;
- Issue a warning;
- Restrict account features;
- Temporarily suspend an account or campaign;
- Close or permanently remove a campaign;
- Prevent additional purchases;
- Cancel an unpaid reservation;
- Delay, restrict, reverse, or recover payments or payouts where permitted;
- Issue or facilitate refunds;
- Respond to disputes or chargebacks;
- Preserve information relevant to an investigation;
- Notify an affected organization, payment provider, rights holder, or other party;
- Report suspected illegal activity to law enforcement or governmental authorities;
- Terminate access to the Service; or
- Take any other action reasonably necessary to protect GiveBrick, supporters, organizers, third parties, or the public.
GiveBrick may act with or without advance notice depending on the seriousness, urgency, recurrence, or legal implications of the conduct.
A refunded or removed brick does not necessarily become available again, and removal of public text does not necessarily reverse the visual reveal associated with the brick.
17. Appeals
An organizer whose campaign has been rejected, restricted, or suspended may contact support@givebrick.com to request reconsideration.
The request should identify the campaign, explain why the decision should be reconsidered, and provide any relevant documentation.
GiveBrick may uphold, modify, or reverse its decision. GiveBrick is not required to provide an appeal for fraud, security threats, legal prohibitions, payment-provider restrictions, repeated violations, or circumstances requiring immediate action.
GiveBrick’s decision after reconsideration is final unless applicable law requires otherwise.
18. No Evasion
You may not assist another person in violating this Policy or attempt to accomplish indirectly what this Policy prohibits directly.
Examples include:
- Using altered spelling or coded language to evade content filters;
- Creating a replacement campaign after suspension;
- Using another person’s account;
- Moving prohibited content to a linked page;
- Dividing prohibited activity among multiple campaigns;
- Mislabeling a political or personal campaign as a school, church, memorial, team, or nonprofit campaign; or
- Moving payment activity outside the platform to avoid an enforcement action or fee.
19. Changes to This Policy
GiveBrick may update this Policy to reflect changes in the Service, payment-provider rules, technology, legal requirements, or community-safety practices.
When the Policy changes, the Effective Date will be updated. Material changes may also be communicated through the Service or by email.
Continued use of the Service after an updated Policy becomes effective constitutes acceptance of the updated Policy.
20. Relationship to Other Policies
This Policy should be read together with the:
If there is a conflict, the Terms of Service control unless applicable law requires otherwise.
The governing-law and dispute provisions in the Terms of Service also apply to this Policy.
